AC Decision to Reject Clubbing Plea: Nawaz Again Moves IHC

Islamabad (November 14, 2017): Former Prime Minister again moved to Islamabad High Court on Tuesday against the decision of the accountability court rejecting his application seeking clubbing together all NAB references against him.

Today Nawaz Sharif’s counsel Azam Nazir Tarar filed the petition in IHC challenging the verdict of the accountability court rejecting his application to club all NAB reference against him together and order a single trial.

It is to be mentioned here that earlier a two-member bench of the Islamabad High Court (IHC) had accepted former prime minister Nawaz Sharif’s plea regarding the Accountability Court’s dismissal of his request to club all references together on the grounds that no reasons for dismissal were given.

The IHC had ordered the accountability court to rehear the application of the former prime minister Nawaz Sharif for clubbing together the references.But the accountability court after re-hearing the application on IHC directives again rejected it.

The petition filed by Azam Tarar on behalf of Nawaz Sharif stated the accountability court rejected the application in indecent haste by ignoring many aspects.

The petition further stated that the accountability court did not consider the reasons mentioned in the IHC order and instead the court rejected the application in haste.

The petition pleaded the court to overturn the accountability court decision to reject the application for clubbing together all the three references. It further pleaded the court to direct the accountability court to club together all the three references and hold single trial of the petitioner.

The petitioner has further pleaded the court to hear the petition on urgent basis and fix the case for hearing today.

The corruption references were filed by the  in light of the Supreme Court’s judgment in the Panama Papers case. Nawaz and his two sons, Hussain and Hasan, are nominated in all three references whereas his daughter Maryam and her husband are only accused in oneThe detailed accountability court order dismissing the plea was issued on November 10, stating that the three references comprise different charges, as opposed to the petitioner’s claim that the accusations are the same.

The judge stated in his ruling that only two witnesses are common among the three references, denying another assertion by Nawaz in his petition.

The judge also remarked that the petitioner wanted to make things easier for himself by getting the three references clubbed
