Special Bench Constituted To Hear Musharraf Treason Case


While hearing the case today at the Supreme Court’s Lahore Registry, the chief justice said the former president should return to the country by 2 pm on Thursday, 14th June.

“How is a [brave] commando so afraid?”

Musharraf’s lawyer informed the court that his client was willing to face the treason charges if he was given the guarantee to be protected.

“My client is ill and a medical board has to examine him,” the lawyer said. To this, the chief justice responded that the court would order the constitution of a medical board. “Musharraf can come back to Pakistan in an air ambulance, and we will order the constitution of a medical board,” remarked Chief Justice Nisar.

He said,”The verdict will be announced in compliance with the law upon Musharraf’s failure to follow the orders.”

Was Musharraf not afraid, when he took over the country? asked CJP?“Musharraf was assured he would get protection but we are not bound to issue a written assurance to him,” said Chief Justice Saqib Nisar.

The apex court noted that it was not bound to comply with any conditions set forth by Musharraf.

Previously on Tuesday, Chief Justice remarked over former President Musharraf’s return that “No agency can influence the court proceedings.”

On June 11, Top Judge of the Apex Court, Justice Mian Saqib Nisar had directed to unblock National Identity Card and passport of Pervez Musharraf so that he can come back to Pakistan.

During the hearing of an issue related to Musharraf’s return, the CJP ordered to constitute tribunal within two days for the trial of the ex-President.

CJP further remarked that Musharraf should not be arrested from the airport as we had given him protection.The top judge further asked former military higher official to return and face all the cases against him.

Earlier, former president Pervez Musharraf on Sunday conditioned his return with a guarantee of justice from courts.

Talking to the newsmen, former President Pervez Musharraf said that he is confused after the verdict of the supreme court.

Musharraf said that he was deprived of passport [after the cancellation of computerized national identity court on orders of special court]. Musharraf stressed on letting him practising politics in Pakistan without any fear.

On June 07, the Apex Court had ordered former President Pervez Musharraf to appear before court and assured he will not be arrested upon appearance.

A three-judge bench, headed by Chief Justice of Pakistan (CJP) Justice Mian Saqib Nisar on Thursday resumed the hearing of Musharraf’s review petition against his disqualification by the Peshawar High Court in 2013.

The bench directed the former military ruler to appear before the top court’s Lahore registry on June 13.

“We will pass an order ensuring authorities do not arrest the former president before his appearance in court,” the CJP added.”The Peshawar High Court (PHC) had announced lifetime disqualification for former president Pervez Musharraf prior to the 2013 general election. Musharraf had filed a plea in 2016 in the Supreme Court against PHC’s verdict.

On June 08, National Registration and Database Authority (NADRA) had suspended the Computerized National Identity Card (CNIC) of General (Retd) Pervez Musharraf.

With the suspension of his CNIC, by default, his passport would also be suspended, sources further stated. As his passport has also been blocked, Musharraf would not be able to travel in any country, due to which his stay in Dubai also becomes illegal.It was also learnt that as a result of the suspension of his documents, the former president has very limited options. Sources said that now he can either seek political asylum or have special documents arranged if he desires to return to Pakistan.

In an unprecedented move, in March 2018, a special court hearing the high treason case against Musharraf had ordered the federal government to suspend his passport and CNIC.The special court in its order had stated that in case the accused fails to submit his written request as mentioned herein above the ministry of interior and all other departments, divisions and agencies of the government of Pakistan are to take positive steps in ensuring the arrest of the accused and attachment of his properties abroad, including suspension of the CNIC and passport of the accused.

Complying with these orders, the Minister of Interior by the end of May had asked NADRA to suspend the CNIC of the former military ruler.
